Katmandos Cattery Contract of Sale
This contract of sale is made and entered into this day ________, 2008 by and between Tyra Rich herein referred to as the seller and _______________________, herein referred to as the purchaser.
I. Warranty
A) Purchaser has 48 hour’s after possession of the kitten to have said kitten examined by a licensed Veterinarian. This examination will be at the purchaser’s expense. Failure to have kitten vet checked within 48 hour’s after possession will make this contract null and void. If a major illness (life threatening only) is detected at that time, purchaser must notify seller within 24 hours of diagnoses. Failure to notify seller within 24 hours will make this contract null and void. Purchaser is entitled to a replacement kitten, upon return of said kitten. Return and replacement expenses will be the purchaser’s responsibility. Purchaser must have Veterinarian’s documentation of major illness to confirm said illness. My local Veterinarian will examine kitten to verify said illness. If my local Veterinarian confirms said illness then and only then would a replacement kitten be given as soon as on of similar quality is made available. After the first two days seller cannot be held responsible. If said kitten should die within the first two days from a major illness then a necropsy report will need to be sent to the seller to verify the major illness was the cause of death. If a necropsy is not performed then the purchaser will not be entitled to a replacement kitten. The necropsy will be at the purchaser’s expense.
B) If your kitten has contracted a major illness after the first two days, the seller cannot be held responsible. If your kitten has contracted a major illness before the first two days you must have followed the guidelines in the paragraph above.
C) Seller warrants and guarantees to the purchaser that said kitten is in good health and free from known disease as of the date of this contract. Said kitten is current on vaccines at time of sale unless otherwise stated (Please see shot record). All adult cats at Katmandos Cattery have been tested and found to be negative for FeLV (Feline Leukemia) and FIV (Feline Immunodeficiency Virus). There are currently no accurate tests for FIP (Feline Infectious Peritonitis) Vaccinating against FIP (Feline Infectious Peritonitis) is not recommended. If you and/or your Veterinarian decide to give this vaccine the seller shall not be held responsible in any way. At no time is seller responsible for any Veterinarian bills that might occur during the kittens’ lifetime.
II. Additional Agreements
1) Seller reserves the right to have said cattery name “Katmandos” at the beginning of said kitten’s TICA registered name.
2) Seller has the right to come in and inspect the said kitten and if found to be living in any inhumane way has the right to repossess said kitten without any opposition or compensation with signed over registration certificate. Purchaser agrees to this by signing.
3) If kitten is sold for breeding/show purposes, seller cannot guarantee that said kitten/cat will perform as well as a show cat should and cannot guarantee said kitten will be able to reproduce. Breeder/Show quality kittens are available to established registered catteries only.
4) If kitten is sold as a pet quality kitten, the kitten will need to be spayed/neutered by 6 months of age. Failure to have said kitten altered by 6 months of age will result in a penalty of $500 and/or repossession of the kitten with no compensation given to the purchaser. The seller hold the kittens TICA registration papers until the kitten has been spayed/neutered. Once the seller receives a copy of the statement from a licensed Veterinarian stating that the said kitten has been spayed/neutered, the seller will produce the TICA registration papers for said kitten.
5) It is understood that the degree of hairlessness varies from cat to cat and that no feline is completely hairless. It is impossible to guarantee that any cat or kitten will not grow hair in the future.
6) It is understood that this kitten will not be allowed to go outside. Said kitten should always have fresh food and water available at all times. We recommend feeding a high quality food such as Iams.
7) A weekly bath and ear cleaning are a must. Sphynx produce skin oil that if left unattended could cause skin issues and ear infections. The ear’s should be cleaned with an ear cleaning solution only, do not use water as this can cause ear infections. Also a good antibacterial/antifungal shampoo is recommended. You can obtain this type of shampoo from a licensed Veterinarian.
8) It is also understood that said kitten will receive annual check up exams and annual vaccinations from a licensed Veterinarian.
9) If for reasons other then the animals health purchaser cannot retain ownership of the said kitten, the seller will be given the first right of refusal with no compensation given.
10) It is also understood that all Veterinarian expenses that might occur are the responsibility of the purchaser. At no time is the seller responsible for Veterinarian expenses.
11) There are NO CASH REFUNDS and NO EXCHANGES at any time.
12) The kitten/cat is expected to be free of any hereditary/genetic/congenital health problems however no guarantee of such can be made or intended herein.
III. Terms of purchase
A non-refundable deposit of $300 will hold your kitten of choice until the agreed upon date. We reserve the right to return the deposit if deem necessary.
In the event of default by the purchaser of any item included herein, it is agreed that the purchaser will pay all court costs, filing fees and attorney fees of the purchaser and the seller. Purchaser further agrees that any action necessary will be brought in the county and the state of the seller.
